This episode examines the recent Timbs v. Indiana decision of the Supreme Court, which incorporates the Eighth Amendment and applies it to the states for the first time in U.S. history. The impact of this important decision is discussed.
The title, "The Triumph of Eight" is a reference to the Eighth Amendment (and acts as a sequel of sorts to a previous work of mine: The Power of Nine, regarding the history of the Ninth Amendment). This is the seventh episode, so it would have made some sense to do this for episode eight, but I could not wait to talk about the impact of this decision, especially because so few will have heard about this decision or understand its implications.
